1.  My Active Health Application
1.1 Mobile App
1.1.1. Welcome to My Active Health Mobile App ("My Active Health App"). My Active Health App is brought to you by the Singapore Sports Council (rebranded as "Sport Singapore" with effect from 1 April 2014 and hereinafter referred to as "SportSG"), and provides you with a one-stop platform for all your Active Health needs. My Active Health App aims to assist you in acquiring knowledge of and creating ownership over your individual health. It provides you with a suite of reinforcements for applying the knowledge you receive for sustained active living at every stage of your life.

1.1.2. We invite you to enjoy the functions available on My Active Health App. However, use of the App is subject to your agreement to these Terms of Use. This document is a contract, and describes the parties’ respective rights and obligations, so please review the contents carefully. If you do not agree with these Terms of Use, you will not be able to use My Active Health App.

1.2. ActiveSG Account
1.2.1. Creation of Account: In order to use My Active Health App, you will need to be a registered ActiveSG user by creating an ActiveSG membership account ("ActiveSG Account"). The ActiveSG Account allows you to make bookings for programmes and/or facilities organised and provided by ActiveSG, a division in SportSG.
More information on ActiveSG, including the ActiveSG Terms of Use (the “ActiveSG Terms”), can be found at www.members.myactivesg.com/terms-conditions/html or on the ActiveSG mobile application (“ActiveSG Mobile App”).

1.2.2. The ActiveSG Terms shall be automatically incorporated by reference into these Terms of Use, and shall apply mutatis mutandis to My Active Health App. Without limiting the generality of the foregoing, references to “App” in the ActiveSG Terms shall be deemed to include My Active Health App in addition to the ActiveSG Mobile App. These Terms of Use shall be considered as supplemental to, and not in any circumstances as subject to, the ActiveSG Terms. In the event of any ambiguity, inconsistency or conflict between these Terms of Use and the ActiveSG Terms, the express provisions of these Terms of Use shall prevail.

1.3. Privacy Policy
1.3.1 Collection of Personal Data
1.3.1.1 Personal data refers to data about an individual who can be identified from either that particular data, or from that data and other information which we have or are likely to have access to. Commonly collected personal data of our customers typically include, amongst other things, names, addresses, telephone (landline and/or mobile) numbers, e-mail addresses, identification numbers, nationalities, dates of birth, credit card information and health and fitness data.


1.3.1.2. Wherever possible, we only collect personal data directly from you. However, certain functions of My Active Health App will require and/or involve the collection and/or sharing of data from/with other platforms (including but not limited to medical/health databases and records as well as other apps such as the Health Promotion Board’s Healthy 365 mobile application, Google Fit, Samsung Health, and Apple HealthKit).


Your data (including personal data where you are an individual) may be collected through the use of My Active Health App and/or the device running My Active Health App, through the aforementioned collection and/or sharing of data from/with other platforms, through the referral of a medical or health practitioner, or through marketing events such as road shows or any other means, for the purpose of planning, administering and use of the various functionalities of My Active Health App.


1.3.1.3. Without limitation, this can occur during or before you:
a. sign up to receive information;
b. set up an ActiveSG Account;
c. use My Active Health App and any of its various functionalities;
d. participate in any activity, event and/or programme through the App;
e. provide any feedback or complaints through My Active Health App;
f. participate in any social media offerings (such as through our Facebook page); and/or
g. participate in any marketing activity held by us.

1.3.1.4. In addition to personal data provided to us, certain information related to you that are not considered personal data may also be collected. We collect this information to improve My Active Health App and other online services.
Such non-personal data may include information such as your IP address, the internet browser you use, details of your interaction with the App, ActiveSG facility and programme booking habits, preferences and information about your health, fitness and lifestyle or preferences such as your hobbies and interests and other types of non-personal data. We may also receive personal information about you from other sources if you have given permission for that information to be shared. This may include information from commercially available sources, such as public databases and data aggregators, and information from third parties.


1.3.1.5. Use of Cookies: Use of Cookies: We and some of our business partners may use data collection devices such as "cookies" on My Active Health App to personalise your online experience, help analyse My Active Health App flow and measure promotional effectiveness. "Cookies" are small files placed on your device and/or hard drive that assist us in providing our services. We may offer features that are only available through the use of a "cookie". We also use cookies to reduce the number of times you need to enter your password. Cookies may also help us provide to you information targeted in accordance to your interests. Most browsers automatically accept cookies but you can modify your browser to decline cookies (if your browser permits you to do so), although in such a case you may not be able to access certain features on My Active Health App or some interactive features offered on My Active Health App may be restricted or rendered inoperable.

1.3.2 Using Your Personal Data
1.3.2.1 We collect personal data for various reasons. The data collected may serve any one or more of these purposes:
a. managing your ActiveSG Account;
b. managing and facilitating your use of My Active Health App and any of its various functionalities;
c. processing your registration for and/or participation in any activity, event and/or programme through My Active Health App;
d. to verify your identity;
e. to conduct market research, survey and/or analysis;
f. improving your experience on My Active Health App;
g. making My Active Health App easier to use and tailoring My Active Health App to your interests and needs;
h. suggesting products, services or programmes by ActiveSG which we think may interest you, but only if you have given us your consent to do so;
i. offering you the opportunity to take part in competitions or promotions organised or co-organised by ActiveSG, but only if you have given us your consent to do so.;
j. to fulfil a legal or regulatory requirement;
k. to respond to your queries and/or feedback;
l. informing you of any changes to these Terms of Use which may affect you; and
m. informing you of updates and/or developments to My Active Health App.


1.3.3. Sharing your Personal Data
1.3.3.1. As a general rule, we do not share your personal data with anyone. However, we may share your personal data with trusted third parties such as:
a. Government agencies (or with non-Government entities which have been authorised to carry out specific Government services) to process any applications you have made or to render you a service, so as to serve you in a most efficient and effective way, unless such sharing is prohibited by law;
b. our advertising, marketing and promotional agencies to help us deliver and analyse the effectiveness of our advertising campaigns and promotions;
c. third parties required to deliver a service to you, such as a software provider or application developer, as well as medical and/or health practitioners;
d. law enforcement or government authorities where they have followed due legal process to request us to disclose the information;
e. third parties who wish to send you information about their products and services, but only if you have given us your consent to do so;
f. third party providers of services, such as data processing; or
g. web analytics tool providers, such as Google.

1.3.3.2. We may share your personal data for the following reasons:
a. reasons provided under clauses 1.3.2.1 and 1.3.3.1 above;
b. verification of your identity;
c. processing transactions through the App;
d. sharing of health and fitness data with your family, friends and/or contacts, but only if you have given us your consent to do so;
e. to enforce applicable terms of use of the App;
f. conduct investigations into possible breaches of applicable laws; and
g. to comply with a court order or other legal or regulatory requirements in the jurisdictions we operate.


1.3.3.3. In situations where a third party under contract with us collects personal data about you, we will require the third party to exercise reasonable care in protecting your information.

1.3.3.4. For your convenience, we may also display to you personal data you had previously supplied to us or other Government agencies. We will retain your personal data only as necessary for the effective delivery of public services to you.
My Active Health App may contain links to non-Government apps and/or sites whose data protection and privacy practices may differ from ours. We are not responsible for the content and privacy practices of these other apps and/or sites and encourage you to consult the privacy notices and/or policies of those apps and/or sites.

1.3.4. Security
1.3.4.1. To safeguard your data, all electronic storage and transmission of data is secured with appropriate security technologies. However, no method of transmission over the Internet or networks, or method of electronic storage, is 100% secure. While security cannot be guaranteed, we strive to protect your personal data and are constantly reviewing and enhancing our security protocols to ensure that your personal data is not subject to unnecessary risks.

1.3.5. Right to Amend this Privacy Policy
1.3.5.1. We reserve the right to amend this Privacy Policy at any time. If material changes are made to this Privacy Policy, they will be posted on this page and date stamped. We encourage you to review this page periodically in order for you to stay notified of any changes.


1.3.5.2. Your continued use of My Active Health App and acceptance of our services after any changes to this Privacy Policy constitutes your consent to any such changes to the extent such consent is not otherwise provided.

1.3.5.3. If you have any inquiries relating to our privacy statement or enquiries about personal data that you have earlier supplied to us, please contact us at sport_qsm@sport.gov.sg.

1.4. Miscellaneous
1.4.1. The contents and functionalities of My Active Health App are for your general information and use only. We do not provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the functionalities, information and/or material found or offered on My Active Health App for any particular purpose. You acknowledge that such functionalities, information and/or material may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

1.4.2. Your use of any functionalities, information or materials on My Active Health App is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any functionalities, products, services or information available through My Active Health App meet your specific requirements.

1.4.3. From time to time My Active Health App may include links to other sites and/or apps. These links are provided for your convenience to provide further information. They do not signify that we endorse the sites and/or apps. We have no responsibility for the contents of the linked sites and/or apps.


1.4.4. Unauthorised use of My Active Health App and its functionalities and contents may give rise to a claim for damages and/or be a criminal offence.

1.4.5. You may not create a link to My Active Health App from another app, site or document without our prior written consent and approval.

1.4.6. The illegality, invalidity or unenforceability of any provision of these Terms of Use under the law of any jurisdiction shall not affect its legality, validity or enforceability under the law of any other jurisdiction nor the legality, validity or enforceability of any other provision.

1.4.7. A person who is not a party to these Terms of Use has no rights under the Contracts (Right of Third Parties) Act, Chapter 53B of Singapore, to enforce any term of these Terms of Use, but this does not affect any right or remedy of a third party which exists or is available apart from the said Act.

1.4.8. All covenants, undertakings and any other obligations given or entered into by us or you are given or entered into severally unless the context otherwise requires.

1.4.9. These Terms of Use shall be governed by and construed in accordance with the law of the republic of Singapore and the courts of the Republic of Singapore shall have exclusive jurisdiction.

1.5. Variations
1.5.1. We reserve the right to determine, amend, add to, delete from or vary the terms and conditions contained in these Terms of Use without prior notification.

1.6. Removal
1.6.1. We reserve the right to suspend and/or remove from the App users who have not complied with these Terms of Use, who are difficult and/or uncooperative, or whose act and conduct we deem to be unreasonable and detrimental to the enjoyment, interests, well-being and safety of other users. Our decision in this respect is final.

2. PART 2. Programme Participation and Use of App
2.1. Programme Participation
2.1.1. We may from time to time organise activities or a series of activities (singularly "Programme", collectively "Programmes"). Details of each Programme can be found on My Active Health App as it becomes available for registration.

2.2. Rules
2.2.2. Each Programme may be subject to its respective terms and conditions supplementing those contained herein.

2.2.3. We reserve the right to modify the Programme and/or its content, revise the Programme fees and/or change the venue of the Programme without prior notice.

2.2.4. We reserve the right, in our sole and absolute discretion, to cancel or reschedule a Programme for any reason whatsoever.

2.2.5. In participating in the Programme, you shall conduct yourself appropriately amongst participants. We reserve the right to remove from the App and/or Programme participants who are difficult and/or uncooperative, or whose act and conduct we deem to be unreasonable and detrimental to the enjoyment, interests, well-being and safety of the other participants. Our decision in this respect is final and we shall not be required to make any refund if you are deemed liable for such behaviour and/or conduct.
As part of the Programme and/or My Active Health App, we may upload course materials and/or resources for your convenience to facilitate learning. You may download these materials only for your own personal and non-commercial use. You may not otherwise copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise transfer any material, nor may you modify or create derivatives works of the material.

2.2.6. The health information and other information on My Active Health App are general in nature. It is provided as a public service and for information purposes only. This information does not constitute medical advice, legal advice or professional services. In particular, the health information on this App is not intended as a substitute for seeing your doctor or other professional advisor. Always consult your doctor if you have any specific health care and/or medical needs. Your doctor can provide the necessary medical diagnosis and treatment. Do not rely on the information on My Active Health App to self-diagnose your illness. You should never disregard medical advice or delay seeking such advice because of anything you read on or through My Active Health App. SportSG shall not be responsible, under any theory of liability or indemnity, for your use of or reliance on the information on My Active Health App.

2.3. Payment and Refunds
2.3.1. Confirmation: Full payment for the Programme is required in order to confirm your registration for the Programme.

2.3.2. Cancellation:
2.3.2.1. by You: In the event you decide to cancel your registration for the Programme after confirmation has been made, no refund shall be given unless otherwise expressly provided for.
2.3.2.2. by Us: in the event we have to cancel or reschedule a Programme (or part thereof), we reserve the right to either (i) conduct a replacement session of the Programme or (ii) offer a refund for the affected Programme (or part thereof).

2.3.3. Refunds: Any and all refunds shall be made to the corresponding component of the eWallet. However, you may request for a refund by cheque by giving us notice of your request, in which case a cheque will be issued to you within 6 - 8 weeks.

2.4. Warranties and Indemnities
2.4.1. By participating in the Programme and/or using My Active Health App, you warrant and represent that you are physically and medically able to participate and have no physical or medical condition that would endanger your life or make your participation in the Programme and/or use of My Active Health App unsafe or dangerous to you or to others.

2.4.2. Whilst reasonable precaution will be taken to ensure your safety, you understand that you participate in the Programme and/or use the App at your own risk. You will not hold us and/or our agent/s liable for any personal injury or death arising from your participation in the Programme and/or use of the App or for any loss of or damage to your property arising from your participation in the Programme and/or use of My Active Health App.

2.4.3. Whilst reasonable precaution will be taken to ensure your safety, you understand that you participate in the Programme and/or use the App at your own risk. You will not hold us and/or our agent/s liable for any personal injury or death arising from your participation in the Programme and/or use of the App or for any loss of or damage to your property arising from your participation in the Programme and/or use of My Active Health App.
